These Telehealth Terms & Conditions (“Telehealth Terms”) govern telehealth and virtual services offered or facilitated by [ LEGAL BUSINESS NAME ] (“we,” “us,” “our”). Telehealth may include, without limitation, video consultations, phone consultations, remote intake, asynchronous messaging, and other technology-enabled healthcare-related interactions (“Telehealth Services”).
These Telehealth Terms should be read together with our Terms of Use, Privacy Policy, and HIPAA Notice of Privacy Practices (linked in the Site footer).
1) Telehealth Is Not for Emergencies
Telehealth Services are not intended for emergency or urgent medical needs. If you believe you may have a medical emergency, call 911 immediately or go to the nearest emergency room.
Do not use website forms, SMS, email, or telehealth messaging for emergencies.
2) No Guarantee of Services; Legal Availability
Telehealth Services are offered only where and as legally permitted. Clinicians must be appropriately licensed or otherwise authorized to provide services to you based on your location and the nature of the service.
We may request your location at the time of service. We may decline or discontinue Telehealth Services if:
- you are located in a jurisdiction where telehealth services are not legally available for the requested service,
- the clinician determines telehealth is not clinically appropriate, or
- technical or operational limitations prevent safe and reliable delivery.
3) Telehealth Has Limitations
You understand and agree that Telehealth Services have limitations compared to in-person care, which may include:
- reduced ability to perform a physical examination,
- reliance on information you provide,
- limitations in diagnostic capabilities,
- potential need for in-person evaluation, imaging, labs, or emergency services.
Clinicians may recommend in-person evaluation or referral to another provider at any time.
4) Technology Risks and Requirements
Telehealth depends on technology, which may fail or be disrupted. Risks may include:
- interruptions, delays, or dropped connections,
- poor audio/video quality affecting communication,
- unauthorized access or security incidents despite reasonable safeguards.
You are responsible for:
- having an appropriate device and stable internet/phone connection,
- being in a private location to the extent possible,
- ensuring your environment is safe during the session (e.g., not driving).
If technical issues prevent completion of a session, we may reschedule or complete the session by telephone where appropriate, to the extent permitted by applicable law.
5) Patient Responsibilities and Accurate Information
You agree to provide accurate and complete information, including:
- your identity and contact information,
- your location at the time of the session (when requested),
- relevant medical history, medications, allergies, and symptoms.
Providing incomplete or inaccurate information can affect care quality and safety.
6) Consent to Telehealth
By scheduling, participating in, or requesting Telehealth Services, you acknowledge and consent that:
- telehealth involves the electronic transmission of information,
- telehealth may have limitations and risks described above,
- you may withdraw consent to telehealth at any time, but withdrawal may affect our ability to provide services.
Withdrawal of telehealth consent does not affect prior services already provided.
7) Privacy and Confidentiality
We take reasonable steps to protect privacy and confidentiality consistent with applicable law and our HIPAA practices. However, you are responsible for taking reasonable steps on your end, including:
- using private networks when possible,
- keeping your device secure,
- ensuring others cannot overhear the session unless you permit them.
For more information, see our HIPAA Notice of Privacy Practices and Privacy Policy (linked in the Site footer).
8) Recording
Unless expressly stated and agreed in advance, telehealth sessions are not intended to be recorded. If recording is used for quality, training, or documentation purposes, we will seek to do so consistent with applicable law and consent requirements.
9) Fees, Billing, and Cancellations
Telehealth fees (if any), payment requirements, and cancellation terms are governed by our Financial Policy and Cancellation & Refund Policy (linked in the Site footer), unless otherwise stated at the time of scheduling.
10) No Guarantee of Outcomes
As with any healthcare-related service, outcomes vary. We do not guarantee results from Telehealth Services.
